Terms of Service

In short: Magellania CRM is a tool for your business. Use it honestly, don't intentionally break it, pay your subscription if you have one — and we'll be fine. This document covers the details.

1. Acceptance of terms

By registering for Magellania CRM or using the service in any way, you agree to these Terms and to our Privacy Policy. If something doesn't work for you, please don't use the service.

If you register on behalf of an organization, you confirm that you have authority to accept these terms on its behalf.

2. Service description

Magellania CRM is a SaaS platform for travel agencies. Core features:

  • Deal pipeline (8 statuses from draft to closed).
  • Multi-currency quote calculation (USD/EUR/RUB/USDT/ARS).
  • Tour, client, and supplier cards.
  • PDF proposal generation.
  • SMTP email delivery.
  • Audit log and 3-tier RBAC.

Exact feature set depends on your tier. We may add or remove features without notice, except where this materially disrupts your business.

3. Account responsibilities

  • One account = one person. Don't share login/password with colleagues — give them their own accounts (included in the tier).
  • You are responsible for password strength and session security.
  • If you notice unauthorized access, notify support@magellania.net immediately and change your password.
  • All actions taken under your account are considered yours.
  • You are responsible for the data you enter into the CRM and for having the right to process your customers' data.

4. Acceptable use

You may: run your business, calculate quotes, send proposals to clients, export data, integrate with other services via the API.

You may not:

  • Use the service for illegal activity (fraud, money laundering, trade in prohibited goods).
  • Resell or sublicense access to Magellania CRM without a written agreement.
  • Reverse-engineer, decompile, or circumvent technical protections.
  • Attack the infrastructure: DDoS, brute-force, pen-testing without written permission.
  • Spam through our SMTP integration (comply with anti-spam laws of your country and the recipients').
  • Upload viruses, malware, or illegal/harmful content.
  • Intentionally overload the API (respect rate limits if using programmatically).

Violations may result in suspension or deletion of your account without refund.

5. Subscription and billing

5.1. Tiers

5.2. Billing

  • Paid tiers are billed monthly in advance.
  • Prices in USD. Local-currency equivalents are approximate.
  • Taxes (VAT, GST) are added if applicable to your jurisdiction.
  • Payment methods: credit/debit card (via processor), bank transfer (Business and Enterprise).
  • If unpaid for 7 days after expiration, the account becomes read-only. After 30 days, it drops to Free mode (active quotes capped at 10).

5.3. Refunds

We do not refund the unused portion of a paid month. You can cancel anytime — service remains available until the end of the paid period. This is standard SaaS practice.

Exception: if we materially degrade the product (e.g., remove a critical feature), you can request a prorated refund.

6. Cancellation and deletion

  • Cancel anytime via profile settings. No phone calls, no justifications.
  • After cancellation, data is available for 30 days — you can return or export.
  • After 30 days, data is permanently deleted (except records we must keep by law: billing up to 4 years).
  • If you want to delete your account immediately, email support@magellania.net.
  • JSON export is available anytime via settings.

7. Intellectual property

  • Your data is yours. Quotes, clients, contacts, text — all yours. We claim no rights to it.
  • The platform is ours. Code, design, logos, the Magellania CRM brand are protected by copyright and/or trademarks.
  • You receive a limited, non-exclusive license to use the service for your business activities for the duration of your subscription.
  • Feedback and suggestions you send us may be used by us without obligation. We don't grant you rights to their implementation, but we don't claim ownership of your ideas either.

8. Service availability

  • Free / Solo / Pro: 99.5% target availability. No formal SLA — service "as is".
  • Business: 99.9% (~ 8.7 hours downtime/year). If we miss it, prorated credit on the next period.
  • Enterprise: SLA negotiated individually.

Planned maintenance is announced at least 48 hours in advance and performed during low-traffic hours.

Emergency work (security patches, infrastructure failures) may proceed without notice — we minimize downtime where possible.

9. Limitation of liability

The service is provided "as is". We strive for reliability but do not guarantee error-free operation or fitness for all your business goals.

Maximum liability of Magellania CRM to you is limited to the subscription fees paid in the last 12 months. This is standard SaaS practice.

We are not liable for:

  • Indirect damages, lost profits, reputational harm.
  • Acts of third parties (Hostinger, Cloudflare, payment processors).
  • Data loss caused by force majeure (natural disasters, state-actor cyberattacks).

This limitation does not apply in cases of gross negligence or willful misconduct on our part, nor to consumer rights mandatory under your local law.

10. Termination

  • You can cancel your subscription anytime.
  • We may suspend or terminate access for material breach with 14 days' notice, except for immediate threats (hacking, spam, illegal activity — terminated immediately).
  • After termination you have 30 days to export your data.

11. Disputes and jurisdiction

For users in Russia and CIS, applicable law is that of the Russian Federation. Disputes are subject to courts at the operator's location.

For users in EU/EEA: you retain all consumer rights provided by your country of residence (including GDPR). These Terms do not diminish those rights.

For users in Argentina and LatAm: local consumer protection laws apply.

Before going to court, please contact us — most issues can be resolved in 1–2 emails.

12. Changes to terms

For material changes (new limits, price changes, new use restrictions) we notify by email at least 30 days before the effective date. You may cancel during this period without penalty.

Minor edits (clarifications, typos) are published immediately with an updated "Effective" date.
